Foreign Extortion Prevention Act Sheds Light on Possible Overreach of the FCPA

March 5, 2025 – Attorney Michael J. Wynne, of Gregor Wynne Arney, PLLC, filed a Notice of Supplemental Authority with the United States District Court for the Southern District of Texas asking the Court to reconsider dismissal of his defendant’s case.  The Notice was filed in light of the newly passed Foreign Extortion Prevention Act (FEPA), which shows that the receipt of bribes by foreign officials was explicitly not illegal prior to the new law.

Potential abuse of the Foreign Corrupt Practices Act (FCPA) and the overexpansive and unpredictable application of the FCPA beyond its intended bounds has been brought to light by a wave of executive dismissals by the Trump administration.  

Michael Wynne wants to achieve recognition of his client’s argument by the judiciary and not simply a political dismissal of the charges.
